Denser Housing Approved Near California Transit Stops

California lawmakers have approved SB 79, the Abundant & Affordable Homes Near Transit Act, which would allow multifamily housing near high-capacity transit stops regardless of local zoning. The measure passed the Legislature 21–8 and now awaits Gov. Gavin Newsom’s decision by Oct. 12.
Authored by Sen. Scott Wiener (D-San Francisco), the bill aims to reduce housing costs and strengthen transit systems by permitting apartments within a half-mile of major rail and rapid bus stops—or a quarter-mile in small cities. Eligible counties include Los Angeles, San Diego, Orange, Santa Clara, Alameda, Sacramento, San Francisco and San Mateo.
Height limits would range from 4 to 9 stories depending on proximity and service frequency, and all projects must meet affordability standards, with incentives for deeper affordability. Protections prohibit demolishing rent-stabilized or recently occupied multifamily units.
SB 79 also allows transit agencies to develop land they own, potentially creating new revenue streams. Advocates say the model mirrors successful transit-oriented housing strategies abroad, while critics argue it overrides local planning powers.
